Legal battle over woman hit by MARTA bus
ATLANTA - An elderly Atlanta woman who was run over by a MARTA bus said she still suffers from dizzy spells and has been unable to lead an independent life.
The accident, which took place in November of 2014, was captured by a MARTA bus camera. Attorney Richard Allen Hunt made the footage available to FOX 5 because he is going public with a complaint that lawyers for the transit agency are not being fair to the pedestrian, Nancy Chalaram Pakis.
The bus driver was attempting to make a left turn from Trinity onto Peachtree in downtown Atlanta. Attorney Hunt said his client was in the crosswalk at the light, and yet she wound up getting cited, not the bus driver.
Hunt claims an Atlanta police accident report is inaccurate. It is what a jaywalking ticket for the pedestrian was based on. That citation, Hunt said, is one of the sticking points which have led to a stalemate in the attempts to settle the case out of court.
MARTA spokesperson Lyle Harris contends MARTA has negotiated in "good faith". He decries what he calls a "ploy" to release information about the case in order to impact the legal system.
