Delicia Cordon's attorney said her client is still trying to recover from the July 10 attack at the home of Buffalo Bills player LeSean McCoy.

"I think people have lost sight of the fact that this woman was the victim of a vicious attack and home invasion," said attorney Tanya Mitchell Graham.

Gordon and her son lived in McCoy's home until just a few weeks ago when someone broke into the house demanding jewelry. Milton police said Cordon was violently assaulted by a man who remains on the run.

"She still needs time to recover. If anyone's ever been the victim of a home invasion and an aggravated battery, you know it takes more than 30 days to recover from that," Cordon's attorney said following an eviction hearing at the Fulton County Courthouse.

Within hours of the home invasion and assault, Gordon's friends took to Instagram suggesting McCoy had something to do with the attack since the items the robber demanded are reportedly the same items Cordon has refused to return to Mr. McCoy since the couple split up earlier this year. McCoy was not in court for the proceedings but was represented by two attorneys during the mediation.

Cordon filed suit against McCoy on August 11, claiming the NFL player should be held financially responsible for the home invasion and items that were taken from McCoy's home.

The suit does not specifically accuse McCoy of being connected to the crime. And 911 calls from the July 10 home invasion, Cordon told the operator McCoy set her up.

McCoy has denied any involvement in the crime and said he hadn't been in contact with Cordon for months.

Milton Police said the home invasion and assault are still under investigation.
